
During the first 30 to 60 days from the date of hiring, The
Miller Law Firm ("Attorney") will undertake to do
the following without charge:
- An on-site preliminary inspection of common areas and the interiors of select units by
our staff construction consultant (licensed general contractor).
- A meeting with the Board of Directors and management representative to present slides of
common area defects and discuss Association's options.
- Survey all homeowners to identify the scope and the extent of the defects and complaints
and prepare a detailed list based on these surveys.
- Undertake a complete and thorough review of the Association documents and the files to
prepare a statute of limitations analysis on the three year statute of limitations (from
date of discovery).
- Pull all recorded notices of completion on the project to be sure we are within the ten
year statute of limitations.
- Conduct site visits with select independent experts to verify existing common area
conditions and homeowner complaints.
- Develop a preliminary budget for the Association regarding proposed expert
investigations.
- Meet again with the Board of Directors upon completion of this analysis to discuss our
findings, recommendations and Association options.
Anticipated staff time to complete these tasks is approximately 50 to 80 hours. In
return, we ask the Board of Directors to sign a fee agreement with us. If, at the end of
this analysis, the Board of Directors decides not to pursue the claim, or to begin to
comply with the Calderon Bill, we will tear up the fee agreement without any financial
impact on the Association.
