Calderon Process Timeline


January 15, 1999 Association sends notice to Builder of compliance with Civil Code §1375 Calderon Process commences.
February 9, 1999 Builder request to meet with Board of Directors is due (25 days after Builder receives Association notice to Builder)
February 9, 1999 Builder must notify insurer of claim, and notify Association of such notice to Builder
February 19, 1999 First Meet and Confer (10 days after Builder's request)
February 20 - March 7, 1999 Association makes site available for testing and inspections
April 6, 1999 Builder may submit second request to meet, written settlement offer, statement of access to funds and test results (30 days from inspections)
April 16, 1999 First possible date for second Meet and Confer (10 days from Builder's request on April 7, 1999)
April 16, 1999 If Association accepts Builder's settlement offer, process ends
April 16, 1999 If Association rejects Builder's settlement offer, Association must give written notice of membership meeting
May 1, 1999 First possible date of membership (15 days after notice to membership is sent)
May 16, 1999 Lawsuit filed (15 days after open meeting)
May 7, 1999 Statute of limitations begins to run again (150 days from January 15, 1999, when statute tolled)
