4 STEPS TO ACTION

CLEAN UP
REPAIR
TEST
DISCLOSE

TWO SCENARIOS FOR MOLD ISSUES:

1. WHERE WATER AND MOLD ARE OPEN AND VISIBLE

Identify and give notice of the triggering event (ie window leak, pipe burst, flood) clean up within 48 hours find source of water and repair cause through a contractor allocate responsibility through association counsel test for mold

II. WHERE WATER AND MOLD ARE SUSPECT BUT UNSEEN
(ie musty smell, sick unit owners)
look to affected unit owner complaints (frequency, numbers, types)
look to building component performance (prior events and performance of component such as HVAC, circulation, plumbing, leaks) consider other (contiguous) units

III. DUTY TO INVESTIGATE AND REPAIR:
Stop water source Testing:
A. Types of testing:
-TAPE
-AIR
-Destructive Testing (determine source of water and mold growth patterns)

B. Testing experts and contractors:
-consult contractors, counsel and experts

IV. DISCLOSURE BY ASSOCIATION
of results (not actual reports)
to units affected
to adjacent units
timely disclosure (triggers statute of limitations)
takes second place to members= safety
