Toxic Mold Forces Family to Move

LAS VEGAS, December 3, 2001 - Toxic mold has moved in, residents are moving out and a class action lawsuit is looming. The builder of the neighborhood in question says they'll repair any problems, but many of the residents say that the mold is so bad, the homes should be leveled.

We're talking about the American West Village located in the northwest area of Las Vegas on Cheyenne just past Durango. Of the homes that have been tested, each one has tested positive for toxic mold.

Corey and his little sister Alley have been in and out of the hospital most of their lives.

Their parents believe it was their home that made them sick. Armed with masks, their attorney takes us in to show us why.

"We’ve taken six samples of six homes. They all come up with toxic mold," says attorney Thomas Miller.

It's evident in the windowsills and the baseboards, and in fact the entire home has been described as a sponge.

The Williams have moved out but new families continue to move in. Others are sticking it out while the builder patches their problems.

"We almost lost both kids... It's absolutely outrageous," says Scott Williams.

"The only thing they can do is tear the house down and rebuild it from scratch," says Miller.

The attorney for the Williams says construction defects are the reason why mold has taken over the home. He says the framing of the windows is especially to blame.

Mold appears because of moisture and he says that for the walls to be crumbling in places, mold must be sitting in every inch of the house.

A representative for American West Builders told us that they're meeting with the Williams' attorney to try and work through these problems.

They say they're unaware a class action lawsuit is being organized, and they also had no idea that residents have been ill because of the mold.
