
June 28, 1999 - A third group
of homeowners of The Seacliff on the Greens Homeowners Association
in Huntington Beach received a multi-million dollar settlement
as a result of a construction defect lawsuit against Orange
County based builders Seacliff Partners Inc.
The settlement will be finalized June 28, 1999, at the
Orange County Superior Court before Judge Philip Petty, just
17 months after the case was filed with the court.
The settlement for The Masters Series at Seacliff on
the Greens Homeowners Association, represented by construction
defect attorney, Thomas E. Miller, came after settlements for
two other associations in the Seacliff master planned community.
These included The Club Series of Seacliff Homeowners
Association, that received $6.2 million in March, 1997, and
The Club Series South of Seacliff on the Greens Homeowners Association,
which recovered $4.7 million in August, 1997.
All three associations were represented by Thomas E.
Miller of Newport Beach.
"It is not uncommon for two or three sub-associations
in a large community to sue the same builder for construction
defects, even though they may be different types of homes, namely
condos, town-homes or single-family homes," according to
Thomas E. Miller, Esq.
The 104 homes in the Masters Series have been plagued
by extreme winter weather, including last year's El Nino driven
storms. The association
sustained severe roof and deck leaks and water intrusion through
windows and sliding glass doors.
The Association claimed these problems were caused by
construction defects due to architectural deficiencies and code
violations. The
developer offered to settle the claims in December of 1997 for
$1 million during the pre-litigation "Calderon" process.
The association rejected this offer and filed suit that
same month.
According to President of the Board of Directors, Lewis
Russakov, "The resolution of this case comes as great news
to the whole community of Seacliff on the Greens.
As the final group of members in this long line of lawsuits,
we are pleased that we were able to obtain the funds to restore
our ideal community."
"We were pleased to obtain the results for
this last group of owners and contribute to the overall restoration
of this beautiful golf community,"
according to the association's attorney, Thomas E. Miller.

than $300 million dollars in construction defect awards on behalf
of California homeowners associations.
