Developer Settles Condo Defects Lawsuit

Las Vegas, May 20, 2001 - The Robert V. Jones Corp., a Las Vegas developer, has agreed to a $1.8 million settlement with Island Park Homeowners Association, a condominium complex plagued with construction defects.

The 92-unit association suffered a variety of building defects, including roof and window leaks, window component failures, cracked stucco, cracked drywall and ponding water in the common area, which the lawsuit alleges were the result of architectural deficiencies and building code violations.

"The defects our community has had to endure will finally be repaired," said Jim Carlin, president of the Island Park Homeowners Association. "We look forward to restoring our association and our homes."

According to Thomas E. Miller of The Miller Law Firm of California, co-counsel with the Law Offices of Robert K. Sparks of Las Vegas, resolution was reached after six months of mediation before mediator Bruce Edwards of J.A.M.S./Endispute.

"This construction defect suit is representative of a local problem and a nationwide phenomenon," Miller said.

Miller and his daughter Rachel Miller, is co-author of a new consumer handbook, Home and Condo Defects: A Consumer Guide to Faulty Construction. The book provides practical "nuts and bolts" strategies for addressing construction defects.

"For most Americans, their home is their single greatest lifetime investment," said Miller. "Unfortunately, as mass production of housing has skyrocketed, shoddy construction has become one of the top problems facing consumers today."

The handbook, published by Seven Locks Press, is available on line at www.ConstructionDefects.com, at Amazon.com and will appear in bookstores this month.

Since 1981, The Miller Law Firm has collected more than $400 million in construction defect awards on behalf of homeowners associations across the Western United States.

Recently Miller and Sparks obtained a $2.75 million mediated settlement against Pius Reiger Construction Inc. on behalf of another Las Vegas condominium association.
