CONCORD PLACE HOMEOWNERS ASSOCIATION
RECOVERS $2.3 MILLION FOR CONSTRUCTION DEFECTS

CERRITOS, CA, August 25, 1999 - The Concord Place Homeowners Association, represented by Thomas E. Miller, The Law Offices of Thomas E. Miller, Newport Beach, recovered $2.3 million for construction defects at the 155-unit residential condominium complex located in Cerritos.  The case was finalized today at the Orange County Superior Court before Judge Robert E. Thomas.

The homeowners at this condominium complex sued their builder for defects that were intensified by last year's El Niño driven storms.  The lawsuit involved the Orange County based 396 Investment Company, and its subcontractors, claiming damages for such defects as roof and deck leaks, related flashing failures, electrical wiring and plumbing failures, as well as ponding water in the common areas.  The association claimed the leaks and other defects were caused by architectural deficiencies and code violations.

The builder and various subcontractors, through their insurance carriers, contributed to the $2.3 million settlement.

“We are extremely pleased to have reached a fair settlement that will end the inconvenience the homeowners have had to endure during the recent winter storms, including El Niño,” according to the President of the Concord Place Association, Lloyd Munger.
