 CONDO ASSOCIATION SETTLES DEFECT SUIT FOR $8.95 MILLION

Santa Ana: An Orange County condominium owners association will receive $8.95 million to settle a 4-year-old construction defects suit, according to an agreement approved last week in Orange County Superior Court.

The settlement will be paid by a consortium of contractors and subcontractors who built the 332-unit complex, said association attorney Thomas E. Miller, a Newport Beach construction defects specialist.

The settlement ends litigation that has been dragging on since 1992, when the Evergreen Homeowners Association sued the builder of the Evergreen Country Villas condo development in Anaheim for defects that included leaky roofs and windows, substandard electrical wiring and other flaws.
