Windsong Assn. Settles Condo Defects Suit

The Windsong Community Assn. of Aliso Viejo agree to a $5-million settlement of its lawsuit, which alleged that its 275-unit condominium development had construction defects, a lawyer representing the homeowners said Friday.

The suit in Orange County Superior Court was brought in 1997 against Pacific Gateway Development, Barratt American, Inc. of Carlsbad, and the builder's joint developing partnership, Windsong Partners, which no longer exits, said Thomas Miller, attorney for the homeowners' group.  Company spokesmen could not be reach for comment, but Miller said the companies and their insurers contributed to the settlement.  The suit alleged that the condos were plagued with a variety of leaks because of construction defects.
